  Question title : franchise licensed trademarks

We have learned that we cannot establish franchise chains in China if MOFCOM will not allow us to register to sell franchises in China unless the licensed trademark is first registered.  Is this correct?

If you do not have a trademark registered with China Trademark office in China, you cannot register it with the franchising authority and therefore you will not be able to expand your franchise operation.

However, one may apply for a copyright certificate, which can then be used to satisfy the franchising registration requirement. A foreigner would need to apply to the State Copyright Bureau or its agent for such a certificate and it generally takes more than two months.
